Leverage Service Terms

These Terms govern access to and use of Leverage, including artificial intelligence, automation, connected systems, human-assisted execution, subscriptions, approvals, integrations, and related services.

Effective: September 1, 2026 Version 1.0 Sixty8 Inc.
Please read these Leverage Service Terms carefully. These Terms supplement the Sixty8 Inc. Terms of Service and Privacy Policy. By purchasing, activating, accessing, configuring, or using Leverage, you agree to these Leverage Service Terms and the applicable Sixty8 general terms. A separately executed agreement, order, Statement of Work, or enterprise agreement may contain additional or different terms.

Section 01

Leverage Service

Leverage is an AI-assisted business execution service provided by Sixty8 Inc. ("Sixty8," "Company," "we," "us," or "our").

Leverage may combine:

  • Artificial-intelligence systems and agents;
  • Automated workflows;
  • AI-assisted preparation and execution;
  • Human review and supervision;
  • Human-led execution;
  • Business-system integrations;
  • Customer-configured permissions;
  • Approval workflows;
  • Task routing;
  • Monitoring and reporting;
  • Communication tools;
  • Research and analysis;
  • Website and technology services; and
  • Other related capabilities made available by Sixty8.

Leverage is intended to increase a Client's operational capacity by routing work among AI systems, automated processes, Sixty8 personnel, and Client approval processes as appropriate.

The specific capabilities available to a Client may depend on the Client's subscription plan, integrations, configuration, permissions, technical environment, and any separately agreed scope of work.

Section 02

Relationship to Sixty8 General Terms

The Sixty8 Inc. Terms of Service are incorporated into these Leverage Service Terms by reference.

Terms defined in the General Terms have the same meaning in these Leverage Terms unless otherwise specified.

Order of Precedence

Separately signed enterprise, custom-service, or other controlling agreement → applicable Leverage order, subscription agreement, or Statement of Work → these Leverage Service Terms → Sixty8 Inc. Terms of Service → applicable service descriptions or documentation.

A pricing page, marketing page, demonstration, estimate, or sales discussion does not modify these Leverage Terms unless expressly incorporated into a written agreement.

Section 03

AI, Human & Hybrid Execution

Leverage may perform work through different execution methods.

AI Execution

Routine, repeatable, informational, preparatory, or otherwise authorized work may be completed by artificial-intelligence systems or automated processes without individual human review.

AI + Human Execution

Certain work may be prepared or performed by AI and subsequently reviewed, corrected, approved, supplemented, or completed by Sixty8 personnel.

Human-Led Execution

Where judgment, discretion, communication, intervention, technical expertise, or hands-on work is appropriate, Sixty8 personnel may perform the work directly.

The execution method used for a particular request may be determined by the request, Client configuration, risk level, system capabilities, applicable permissions, available human capacity, and Sixty8 operational policies.

Leverage does not guarantee that every task will be performed exclusively by AI or exclusively by a human.

Section 04

Client Instructions & Delegated Authority

The Client may submit requests, instructions, standing rules, workflows, and other directions to Leverage.

The Client authorizes Sixty8 and Leverage to take actions reasonably necessary to fulfill authorized requests within the permissions, systems, accounts, and boundaries established by the Client.

This authorization may include, where enabled:

  • Reading information;
  • Searching authorized systems;
  • Creating drafts;
  • Creating or updating records;
  • Preparing communications;
  • Sending authorized communications;
  • Updating website content;
  • Modifying authorized files or configurations;
  • Coordinating schedules;
  • Creating tasks;
  • Interacting with APIs;
  • Triggering workflows;
  • Communicating with authorized third parties;
  • Performing technical work; and
  • Taking other actions expressly authorized by the Client.

The Client is responsible for ensuring that it has the legal and contractual authority to instruct Sixty8 to access or act upon any connected account, system, information, or resource.

Section 05

Access Does Not Equal Authorization

Connecting a system to Leverage does not automatically authorize every possible action within that system.

Leverage may distinguish between access rights and execution rights.

Read — Leverage may view or retrieve authorized information.
Create — Leverage may create drafts, files, records, messages, tasks, or other content without necessarily publishing, sending, or executing them.
Execute — Leverage may perform predefined or authorized actions without requesting separate approval for each occurrence.
Approval Required — Leverage may prepare an action but pause execution until approval is received from an authorized Client user.
Human Required — A request may be routed to Sixty8 personnel before execution.

The Client is responsible for reviewing and maintaining its permission configuration.

Section 06

Approval Workflows

Certain actions may be configured or designated as requiring Client approval.

Examples may include:

  • Publishing production website changes;
  • Sending significant external communications;
  • Deleting information;
  • Altering important business records;
  • Making material account changes;
  • Performing sensitive technical operations; or
  • Other actions designated by the Client or Sixty8 as requiring approval.

When approval is required, Leverage may prepare the work and hold the proposed action until an authorized Client user approves, rejects, or requests changes.

Approval through an authenticated Leverage or Sixty8 account may be treated as authorization to execute the associated action.

Sixty8 may maintain records of approvals, instructions, execution history, and related system activity.

Section 07

Authorized Users

The Client is responsible for determining which employees, contractors, representatives, or other individuals may use its Leverage account.

The Client is responsible for:

  • Assigning appropriate access;
  • Maintaining current user permissions;
  • Removing access when authorization ends;
  • Protecting login credentials;
  • Maintaining appropriate account security; and
  • Reviewing material account activity.

Instructions submitted through a properly authenticated authorized account may be treated as instructions from the Client unless Sixty8 has reason to believe the account has been compromised or the instruction is unauthorized.

Section 08

Connected Systems & Accounts

Leverage may connect to Client-authorized third-party systems, which may include:

  • Email;
  • Calendars;
  • Document systems;
  • Cloud storage;
  • Websites;
  • Content-management systems;
  • Customer relationship management systems;
  • Accounting platforms;
  • Communication platforms;
  • Hosting accounts;
  • Domain providers;
  • Marketing systems;
  • Cloud infrastructure;
  • APIs;
  • Databases;
  • Business applications; and
  • Other supported systems.

The Client authorizes Sixty8 to establish and maintain requested integrations using credentials, authorization tokens, API keys, application permissions, service accounts, or other access mechanisms approved by the Client.

The Client remains responsible for maintaining its underlying third-party accounts and complying with their applicable terms.

Section 09

Credentials & Security

The Client may provide credentials or authorize Leverage to obtain delegated access to third-party systems.

Where reasonably available, Sixty8 may use methods such as OAuth authorization, scoped API credentials, service accounts, or other limited-access mechanisms rather than requesting primary account passwords.

Clients should grant only the access reasonably necessary for the requested Services.

The Client is responsible for promptly notifying Sixty8 when:

  • An authorized user should be removed;
  • A credential has been compromised;
  • An integration should be disconnected;
  • A connected account changes ownership or authorization; or
  • Access is no longer permitted.

Sixty8 may suspend an integration when it reasonably believes continued access presents a security or authorization risk.

No security system can guarantee complete protection against unauthorized access, cyberattacks, service failures, credential compromise, or other security incidents.

Section 10

Artificial Intelligence Limitations

Artificial-intelligence systems are probabilistic and may produce inaccurate, incomplete, inconsistent, outdated, misleading, or otherwise unsuitable results.

AI-generated material may include errors involving:

  • Facts;
  • Calculations;
  • Recommendations;
  • Summaries;
  • Code;
  • Research;
  • Communications;
  • Classifications;
  • Analysis;
  • Images;
  • Documents; or
  • Other generated output.
Human Review Notice

The presence of human support within Leverage does not mean that every AI-generated output receives human review.

The Client is responsible for selecting appropriate permission and approval levels based on the consequences of an action.

The Client should use increased human review for decisions or actions involving significant legal, financial, employment, health, safety, regulatory, contractual, cybersecurity, or other material consequences.

Leverage is not a substitute for licensed legal, accounting, investment, medical, tax, or other regulated professional advice.

Section 11

Human Support

Certain Leverage subscription plans may include a stated amount of human support capacity.

Human support may be used for activities such as:

  • Review;
  • Escalation;
  • Communication;
  • Judgment calls;
  • Corrections;
  • Intervention;
  • Technical work;
  • Hands-on execution; and
  • Other work requiring a person.

Included human-support capacity is a service allowance and does not represent guaranteed staffing, dedicated employment, or reserved full-time availability unless expressly stated in a separate agreement.

Unused included human capacity does not roll over to a subsequent billing period unless expressly stated otherwise.

Tasks requiring additional human involvement beyond included capacity may require additional fees.

Unless another rate is stated in the applicable order or agreement, additional human execution may be billed at Sixty8's then-current published or quoted rate.

Section 12

Subscription Plans

Leverage may be offered through subscription plans with different capabilities, limits, integrations, priority levels, human-support allowances, and service features.

Plan descriptions may identify:

  • Monthly or annual subscription fees;
  • AI execution capacity;
  • Number or type of connected systems;
  • Human-support capacity;
  • Request priority;
  • Workflow capabilities;
  • Approval features;
  • Integration availability;
  • Support level; and
  • Other plan-specific features.

Sixty8 may modify the features included in future subscription offerings.

Material changes to an active paid subscription will be handled according to the applicable order, subscription commitment, notice terms, and applicable law.

Section 13

Billing

Subscription charges are billed according to the billing cycle selected by the Client.

Unless otherwise stated in an applicable order:

  • Monthly subscriptions are billed in advance for each monthly service period;
  • Annual subscriptions are billed in advance for the applicable annual service period;
  • Usage-based or additional human-service charges may be billed separately; and
  • Applicable taxes and third-party costs may be charged in addition to subscription fees.

The Client authorizes Sixty8 and its payment provider to charge the payment method associated with the account for amounts properly due.

Failure to maintain a valid payment method or timely pay undisputed charges may result in suspension or termination of Leverage.

Section 14

Annual Plans & Promotional Pricing

Annual subscriptions may be offered at discounted or promotional rates.

Where Sixty8 expressly offers a fixed introductory rate for an initial annual term, that rate will remain fixed for the stated initial term unless the Client changes plans, adds separately billed Services, or otherwise agrees to different pricing.

Pricing applicable to a subsequent renewal term may change upon reasonable advance notice unless otherwise stated in a controlling agreement.

Promotional or introductory pricing may be discontinued for new purchases at any time.

Section 15

Renewals & Cancellation

Renewal and cancellation terms applicable to a subscription will be disclosed in the applicable checkout process, order, subscription agreement, or Client Portal.

Unless otherwise stated, cancellation stops future renewal and does not retroactively refund amounts already paid for an active billing period.

The Client remains responsible for charges properly incurred before the effective cancellation date.

If an annual commitment includes different cancellation rights, early termination terms, or non-refundable amounts, those terms will be identified in the applicable order or agreement.

Nothing in this section limits cancellation, refund, or renewal rights that cannot lawfully be waived.

Section 16

Additional Services & Out-of-Scope Work

A Leverage subscription does not include unlimited human labor, custom software development, major website redesigns, substantial infrastructure projects, complex migrations, or other significant professional services unless expressly stated.

A request may be classified as additional or out-of-scope work where it materially exceeds the capabilities, capacity, or scope of the applicable subscription.

Sixty8 may provide an estimate, additional hourly rate, Statement of Work, change order, or separate Project Agreement before beginning material out-of-scope work.

Section 17

Third-Party Services

Leverage may depend upon independent third-party providers, including providers of:

  • Artificial intelligence;
  • Cloud computing;
  • Email;
  • Communications;
  • Hosting;
  • APIs;
  • Productivity software;
  • Databases;
  • Authentication;
  • Payment processing;
  • Analytics;
  • Content management; and
  • Other business technology.

Sixty8 does not control third-party providers and cannot guarantee their continued availability, functionality, pricing, policies, security, output quality, or compatibility.

Third-party outages, limitations, rate limits, API changes, authentication failures, service restrictions, or discontinued products may temporarily or permanently affect Leverage functionality.

Sixty8 may modify an integration, use an alternative provider, or discontinue an affected capability where reasonably necessary.

Section 18

Client Data

The Client retains its ownership rights in Client Content.

The Client grants Sixty8 the rights reasonably necessary to access, process, transmit, store, transform, and use Client Content for the purpose of providing Leverage.

Client Content may be transmitted to authorized third-party systems where necessary to perform requested Services.

Sixty8's handling of personal information is also governed by its Privacy Policy and any applicable Data Processing Agreement.

The Client should not submit or connect information that Sixty8 has expressly prohibited or that the Client does not have authority to provide.

Any special requirements concerning data residency, retention, model training, confidential information, regulated data, or specific AI providers should be agreed upon in writing before the affected information is processed.

Section 19

Confidential Information

Information accessed through Leverage may include confidential business information.

Sixty8 will use reasonable care to protect confidential information and use it for purposes reasonably related to performing the Services.

The Client acknowledges that authorized execution may require confidential information to be processed by Sixty8 personnel, software, infrastructure providers, AI providers, or other authorized subprocessors where reasonably necessary.

More specific confidentiality requirements may be established through a nondisclosure agreement, enterprise agreement, Data Processing Agreement, or other written agreement.

Mutual Confidentiality

Confidentiality obligations under these Leverage Service Terms apply to both Sixty8 and the Client.

Client Confidential Information may include business records, customer information, credentials, files, communications, Connected-System data, technical information, financial information, and other non-public information accessed through Leverage.

Sixty8 Confidential Information may include Leverage architecture, software, agents, prompts, workflows, automation logic, connectors, internal tools, security methods, documentation, pricing, operational procedures, unreleased features, and other proprietary technology or business information.

Each party will use reasonable care to protect the other party's Confidential Information and will use it only for authorized purposes related to the parties' relationship.

Section 20

Activity Logs & Records

Leverage may maintain activity records concerning:

  • Requests;
  • Instructions;
  • AI processing;
  • Human intervention;
  • Approvals;
  • System access;
  • Executed actions;
  • Connected systems;
  • Communications;
  • Errors;
  • Security events; and
  • Other service activity.

These records may be used for:

  • Providing the Services;
  • Troubleshooting;
  • Security;
  • Auditing;
  • Customer support;
  • Billing;
  • Quality assurance;
  • Dispute resolution; and
  • Legal compliance.

Activity history is not guaranteed to constitute a complete forensic, accounting, legal, or regulatory record unless expressly agreed in writing.

Section 21

Backups & Production Changes

Leverage may perform authorized work on websites, files, software, infrastructure, databases, or other production systems.

The Client remains responsible for maintaining appropriate backups and recovery procedures for Client-controlled systems unless backup responsibility has expressly been assigned to Sixty8 in writing.

Where practical and appropriate, Sixty8 may use staging environments, revision history, backups, version control, change previews, or other safeguards before performing material production changes.

The availability of such safeguards depends on the underlying platform and the Services being performed.

The Client acknowledges that authorized changes to production systems may result in unintended effects, incompatibilities, downtime, data changes, or other technical consequences.

Section 22

Communications on the Client's Behalf

Where authorized, Leverage or Sixty8 personnel may draft or send communications on the Client's behalf.

These may include communications with:

  • Customers;
  • Leads;
  • Vendors;
  • Partners;
  • Contractors;
  • Employees;
  • Service providers; or
  • Other authorized recipients.

The Client is responsible for ensuring requested communications comply with applicable laws, contractual obligations, advertising rules, privacy requirements, consent requirements, and other obligations applicable to its business.

Sixty8 may decline to send or assist with communications that it reasonably believes are unlawful, deceptive, abusive, fraudulent, or otherwise prohibited.

Section 23

Client Responsibilities

In addition to responsibilities stated in the General Terms, the Client is responsible for:

  • Providing accurate instructions;
  • Setting appropriate permissions;
  • Designating authorized users;
  • Reviewing approval requests when required;
  • Maintaining access to connected third-party systems;
  • Providing accurate account information;
  • Maintaining appropriate backups;
  • Protecting credentials;
  • Monitoring its business systems;
  • Reviewing material outputs and actions;
  • Maintaining legally required records;
  • Ensuring requested activities are lawful;
  • Obtaining required third-party permissions or consents; and
  • Promptly notifying Sixty8 of material changes affecting authorization.

The Client is responsible for business decisions made based upon information, recommendations, drafts, analysis, or outputs provided through Leverage.

Section 24

Prohibited Uses

Leverage may not knowingly be used to:

  • Violate applicable law;
  • Commit, facilitate, or conceal fraud;
  • Access systems or information without authorization;
  • Send unlawful spam or deceptive communications;
  • Distribute malware;
  • Bypass security controls;
  • Conduct unlawful surveillance;
  • Harass, threaten, or exploit individuals;
  • Infringe intellectual-property rights;
  • Misrepresent identity or authorization;
  • Create materially deceptive impersonations;
  • Facilitate illegal financial activity;
  • Make prohibited automated decisions;
  • Interfere with systems or networks;
  • Generate or distribute unlawful content; or
  • Place Sixty8, its personnel, infrastructure, providers, Clients, or third parties at unreasonable legal, operational, or security risk.

Sixty8 may refuse, limit, pause, or terminate requests that it reasonably believes violate these requirements.

Section 25

High-Impact & Regulated Activities

Human Oversight Required

Unless expressly agreed in writing, Leverage is not designed to autonomously make final high-impact or regulated decisions.

Examples include decisions concerning:

  • Medical diagnosis or treatment;
  • Legal rights or legal representation;
  • Credit eligibility;
  • Lending;
  • Insurance eligibility;
  • Investment decisions;
  • Employment termination;
  • Hiring decisions;
  • Housing eligibility;
  • Emergency response;
  • Life-safety operations; or
  • Other similarly consequential regulated decisions.

Leverage may assist with administrative, research, organizational, or preparatory activities in these areas where lawful, but appropriate qualified human review remains required.

Section 26

Service Availability

Sixty8 will use commercially reasonable efforts to provide Leverage but does not guarantee uninterrupted or error-free availability.

Leverage may be affected by:

  • Scheduled maintenance;
  • Emergency maintenance;
  • Software defects;
  • Cybersecurity events;
  • Infrastructure failures;
  • Internet outages;
  • AI-provider outages;
  • Third-party API failures;
  • Rate limits;
  • Account restrictions;
  • Authentication failures;
  • Client-system outages;
  • Force majeure events; or
  • Other circumstances outside Sixty8's reasonable control.

Features may occasionally be unavailable, delayed, degraded, or temporarily disabled.

Section 27

Beta & Experimental Features

Sixty8 may make beta, preview, experimental, early-access, or newly developed capabilities available through Leverage.

Such features may change materially, contain defects, operate unpredictably, be discontinued, or have limited support.

Unless expressly stated otherwise, beta or experimental capabilities should not be relied upon for critical production operations without appropriate Client safeguards.

Section 28

Suspension

Sixty8 may suspend all or part of Leverage where reasonably necessary because of:

  • Nonpayment;
  • A material breach of applicable terms;
  • Security concerns;
  • Suspected credential compromise;
  • Fraud;
  • Unlawful activity;
  • Abuse;
  • Excessive or harmful system usage;
  • Third-party account restrictions;
  • Risk to Sixty8 systems or personnel; or
  • Risk to another Client or third party.

Where reasonably practicable, Sixty8 will attempt to provide notice and an opportunity to resolve the issue.

Emergency or security-related suspension may occur without advance notice.

Section 29

Termination & Offboarding

Upon termination or expiration of Leverage, Sixty8 may:

  • Disable Leverage access;
  • Stop automated workflows;
  • Disconnect integrations;
  • Revoke Sixty8-controlled credentials or tokens;
  • Remove Sixty8 personnel from authorized systems;
  • Stop scheduled tasks; and
  • Begin applicable data-retention or deletion processes.

The Client is responsible for independently revoking credentials or third-party permissions it directly controls.

Where included in the applicable plan or agreement, Sixty8 may provide reasonable assistance with transition or data export.

Extended migration, custom export, documentation, integration removal, or transition assistance may constitute additional Services.

Termination does not eliminate payment obligations or other provisions that by their nature survive termination.

Section 30

Intellectual Property

Client Content

The Client retains ownership of Client Content.

Leverage Platform

Sixty8 retains all rights in and to Leverage and Sixty8 technology, including:

  • Software;
  • Platform architecture;
  • Agents;
  • Automation frameworks;
  • Workflows;
  • Prompting systems;
  • APIs;
  • Connectors;
  • Templates;
  • Internal tools;
  • Methods;
  • Processes;
  • Libraries;
  • Algorithms;
  • Documentation;
  • Interfaces; and
  • Other background technology.

Purchasing a Leverage subscription does not transfer ownership of Sixty8 technology.

Client-Specific Work

Ownership or licensing of separately commissioned custom software, designs, documents, or other Deliverables will be governed by the applicable Project Agreement.

Section 31

Feedback

If the Client voluntarily provides suggestions, feature requests, workflow ideas, or other feedback concerning Leverage, Sixty8 may use that feedback to develop and improve its products and Services without creating an obligation to compensate the Client.

This does not grant Sixty8 ownership of the Client's confidential information, proprietary business data, or Client Content.

Section 32

No Employment or Agency Relationship

Leverage human support does not create an employment relationship between the Client and Sixty8 personnel.

Unless expressly authorized in writing for a specific purpose, neither Leverage nor Sixty8 personnel are the Client's legal agent, fiduciary, officer, employee, partner, or representative with authority to legally bind the Client to contracts or obligations.

Authorization to perform operational actions on a Client's behalf does not create a general agency relationship.

Section 33

Warranties & Disclaimers

Except for warranties expressly stated in a written agreement, Leverage is provided on an "as available" basis to the maximum extent permitted by applicable law.

Sixty8 does not guarantee:

  • AI accuracy;
  • Error-free output;
  • Uninterrupted availability;
  • Completion of every request;
  • Specific turnaround times unless expressly agreed;
  • Specific business outcomes;
  • Increased revenue;
  • Cost savings;
  • Customer satisfaction;
  • Third-party service availability;
  • Continued integration compatibility;
  • Detection of every error or security issue; or
  • That every automated action will produce the intended result.

Clients remain responsible for determining whether Leverage is appropriate for their business processes and risk tolerance.

Section 34

Limitation of Liability

The limitation-of-liability provisions of the Sixty8 Inc. Terms of Service apply to Leverage.

To the maximum extent permitted by applicable law, Sixty8 is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from Leverage, including lost profits, lost revenue, loss of opportunity, loss of goodwill, business interruption, or loss of data.

To the maximum extent permitted by applicable law, Sixty8's aggregate liability arising from Leverage will not exceed the amount paid by the Client to Sixty8 for Leverage during the twelve months immediately preceding the event giving rise to the claim, unless a different limitation is expressly stated in a controlling written agreement.

Nothing in these Leverage Terms excludes liability that cannot legally be excluded or limited.

Section 35

Indemnification

The indemnification provisions contained in the Sixty8 Inc. Terms of Service apply to Leverage.

Without limiting those provisions, the Client is responsible, to the extent permitted by law, for third-party claims arising from:

  • Client instructions;
  • Client Content;
  • Unauthorized or unlawful use of Leverage;
  • Systems the Client did not have authority to connect;
  • Communications requested by the Client;
  • Client violations of applicable law;
  • Client violations of third-party rights; or
  • The Client's material breach of these Leverage Terms.

Additional or reciprocal indemnification obligations may be established in a separately signed agreement.

Section 36

Changes to Leverage

Leverage will continue to evolve.

Sixty8 may add, modify, replace, or discontinue functionality as technology, business requirements, security conditions, regulations, providers, and customer needs change.

Where a change materially affects an active paid subscription, Sixty8 will provide notice as reasonably required by the nature of the change, contractual commitments, and applicable law.

Continued use after an effective change to these Leverage Terms constitutes acceptance to the extent permitted by law.

Section 37

Governing Law & Dispute Resolution

These Leverage Terms and disputes arising from them will be governed by the laws of the State of IOWA, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Subject to any controlling dispute-resolution agreement, proceedings concerning Leverage or these Leverage Terms will be brought in the state or federal courts located in JACKSON COUNTY, IOWA, and each party consents to the jurisdiction of those courts, except where such a provision is prohibited by applicable law.

Section 38

General Provisions

Changes

Sixty8 may update these Leverage Terms from time to time. The revised version will display an updated effective date.

Severability

If any provision of these Leverage Terms is determined to be unenforceable, the remaining provisions will remain effective to the extent permitted by law.

No Waiver

Failure to enforce a provision does not waive the right to enforce that provision later.

Assignment

Assignment rights will be governed by the General Terms and any applicable controlling agreement.

Entire Agreement

These Leverage Terms, the General Terms, Privacy Policy, applicable subscription or order documents, and any controlling written agreement constitute the agreement between the parties concerning Leverage and supersede inconsistent prior representations concerning the same subject matter.
