Kickstart Service Terms

These Terms govern Kickstart engagements, including intake, service selection, scope confirmation, fees, third-party costs, business-formation support, deliverables, and related professional services.

Please read these Kickstart Service Terms carefully. These Terms supplement the Sixty8 Inc. Terms of Service and Privacy Policy. A proposal, order, Statement of Work, service agreement, or other Project Agreement may contain additional or different terms. Where a controlling written agreement expressly conflicts with these Kickstart Service Terms, the more specific written agreement controls with respect to that conflict.

Kickstart Service

Kickstart is a professional-services offering provided by Sixty8 Inc. ("Sixty8," "Company," "we," "us," or "our") intended to help businesses, founders, and organizations identify, organize, establish, or execute a practical starting point for a business, brand, digital presence, launch, or growth initiative.

Kickstart may include planning, consulting, research, creative services, business setup support, branding, website services, marketing preparation, software or systems planning, documentation, implementation, or other services expressly included in the applicable Project Agreement.

Relationship to Sixty8 General Terms

The Sixty8 Inc. Terms of Service are incorporated into these Kickstart Service Terms by reference. Terms defined in the General Terms have the same meaning here unless otherwise stated.

Order of Precedence

Separately signed Project Agreement, Statement of Work, or other controlling agreement → applicable Kickstart order or proposal → these Kickstart Service Terms → Sixty8 Inc. Terms of Service → applicable service descriptions or marketing materials.

Marketing pages, pricing pages, examples, estimates, demonstrations, or sales discussions do not modify an engagement unless expressly incorporated into a written agreement.

Intake & Engagement Formation

Submitting a Kickstart intake does not by itself create a project engagement, obligate Sixty8 to accept the work, guarantee availability, reserve production capacity, or require either party to proceed.

Sixty8 may review the intake, request clarification, recommend a different Kickstart option, propose a Custom Project or other service, decline the request, or identify additional work that would require a separate scope or agreement.

A binding service engagement begins only when the applicable proposal, order, invoice, agreement, acceptance process, or other written authorization required by Sixty8 has been completed.

Product Selection & Scope Confirmation

A Kickstart option selected during intake represents the Client's requested starting point. It is not a guarantee that the selected option is the most appropriate engagement or that every item associated with that option will apply to every Client.

Final scope, deliverables, exclusions, schedule, responsibilities, and fees are determined by the applicable Project Agreement.

Where the Client's needs materially exceed or differ from the selected Kickstart option, Sixty8 may recommend a different option, a revised scope, a Custom Project, or additional Services.

Kickstart Options

Kickstart may be offered through service levels or starting points such as Blueprint, Business Foundation, Start, Launch, Grow, or other options made available by Sixty8.

These names describe general service categories and do not independently create a fixed list of deliverables. The applicable Project Agreement controls the actual work included in a specific engagement.

Sixty8 may revise, rename, combine, discontinue, or introduce Kickstart options for future engagements without changing the scope of an already accepted Project Agreement.

Fees & Third-Party Costs

Published Kickstart prices may be stated as fixed fees, starting prices, estimates, or other pricing structures. The amount applicable to a particular engagement will be identified in the applicable order, proposal, invoice, or Project Agreement.

Unless expressly included in writing, the Client is responsible for third-party costs required for the engagement, including government filing fees, registered-agent fees, domain registration, hosting, software, premium plugins, licenses, advertising, payment-processing costs, stock assets, printing, shipping, or other external expenses.

Additional Services or work outside the confirmed scope may require a revised estimate, change order, additional fee, or separate Project Agreement.

Business Foundation Limitations

Business Foundation and related Kickstart services may include administrative assistance, organization, preparation of information, coordination, filing support, website or brand setup, or other implementation work expressly identified in the applicable scope.

Sixty8 is not a law firm, accounting firm, tax preparer, financial advisor, or licensed professional service provider merely by offering Business Foundation or other Kickstart services.

Unless separately stated in writing by a properly licensed professional, Sixty8 does not provide legal, tax, accounting, securities, investment, or regulated professional advice.

The Client remains responsible for deciding which legal entity, tax treatment, jurisdiction, licenses, permits, elections, registrations, contracts, or compliance obligations are appropriate for the Client's business.

Sixty8 may recommend that the Client consult an attorney, accountant, tax professional, financial professional, insurance professional, or other qualified advisor where appropriate.

Client Responsibilities

The Client is responsible for:

  • Providing accurate and complete information;
  • Providing timely decisions, approvals, content, files, and credentials;
  • Confirming spelling, ownership details, addresses, names, business information, and other submission data;
  • Obtaining appropriate rights to content, trademarks, images, data, and materials supplied to Sixty8;
  • Reviewing drafts, proofs, applications, filings, websites, and Deliverables when requested;
  • Maintaining required third-party accounts and licenses; and
  • Complying with laws and industry obligations applicable to the Client's business.

Sixty8 may rely on information supplied or approved by the Client unless Sixty8 has expressly agreed to independently verify that information.

Timing & Dependencies

Any schedule, launch target, filing timeline, production date, or estimated completion period may depend on Client responsiveness, approval timing, content readiness, third-party systems, government agencies, registrars, hosting providers, vendors, software providers, or other dependencies.

Delays caused by missing information, Client approvals, external review, third-party availability, filing-office processing, technical limitations, or circumstances outside Sixty8's reasonable control may extend the schedule.

Unless expressly guaranteed in a signed Project Agreement, dates are targets or estimates rather than guaranteed deadlines.

Deliverables, Revisions & Additional Work

Deliverables, concepts, revision rounds, file formats, technical features, implementation tasks, and support obligations are limited to those identified in the applicable Project Agreement.

Requests that materially expand or alter the approved scope may require a change order, revised price, revised schedule, or separate engagement.

Sixty8 is not required to begin material out-of-scope work until the parties have agreed to the applicable terms.

Third-Party Services, Filings & Approvals

Kickstart may depend on independent third parties, including government agencies, domain registrars, hosting companies, payment processors, software vendors, banks, registered-agent providers, cloud platforms, email providers, social platforms, advertising platforms, and other external services.

Sixty8 does not control third-party processing times, acceptance criteria, account decisions, policies, pricing, outages, feature changes, filing outcomes, approval decisions, or continued availability.

Where Sixty8 assists with a filing or submission, the Client remains responsible for reviewing and authorizing the information submitted on the Client's behalf.

No Guaranteed Business Outcomes

Kickstart is intended to provide professional assistance, planning, implementation, and a practical starting point. It does not guarantee a particular business outcome.

Sixty8 does not guarantee:

  • Business formation or government approval;
  • Approval of a filing, license, account, merchant application, financing request, or third-party service;
  • A particular launch date;
  • Revenue, profitability, customer acquisition, funding, investment, or business success;
  • Search-engine rankings, advertising results, traffic, conversions, or sales;
  • Availability or performance of third-party systems; or
  • That a particular business concept, product, service, or market strategy will succeed.

Intellectual Property, Confidentiality & Portfolio Use

Intellectual-property ownership, licensing, confidentiality, Client Content, Sixty8 background technology, third-party materials, and portfolio use are governed by the Sixty8 Inc. Terms of Service and any applicable Project Agreement.

Ownership or licensing of final Deliverables may be conditioned on full payment or other obligations stated in the applicable Project Agreement.

Cancellation, Suspension & Termination

Cancellation rights, refund terms, non-refundable amounts, suspension rights, work-in-progress treatment, and termination obligations will be governed by the applicable Project Agreement, invoice, order, and the Sixty8 Inc. Terms of Service.

Unless otherwise required by law or expressly agreed in writing, cancellation does not eliminate responsibility for Services already performed, approved third-party expenses, committed external costs, or other amounts properly incurred before cancellation.

No Investment, Financing or Partnership Created

Kickstart is not a loan, grant, investment, financing product, accelerator admission, equity arrangement, revenue-sharing agreement, or partnership offer.

No investment, financing, ownership, revenue participation, or similar relationship is created by submitting a Kickstart intake, purchasing Kickstart Services, discussing a project, or receiving a Kickstart recommendation.

Any such arrangement exists only if separately documented in a written agreement executed by the applicable parties.

Liability, Disputes & General Terms

The warranty disclaimers, limitation-of-liability provisions, indemnification provisions, governing-law provisions, dispute-resolution terms, severability, assignment, waiver, and other general provisions contained in the Sixty8 Inc. Terms of Service apply to Kickstart.

Unless a controlling Project Agreement states otherwise, these Terms are governed by the laws of the State of Iowa, and applicable proceedings will be brought in the state or federal courts located in Jackson County, Iowa, subject to applicable law.

Changes & Contact Information

Sixty8 may update these Kickstart Service Terms from time to time. The revised version will display an updated effective date.

Changes to these Terms do not retroactively change an already accepted Project Agreement unless the parties agree otherwise or applicable law permits the change.
